Terms of Service

Version 2026-09-17

These terms govern your use of Take, a marketplace that connects brands with creators who produce short video content. By creating an account you agree to them. If you are accepting on behalf of a company, you confirm you are authorised to bind that company.

1. Who can use Take

You must be at least 18 years old and able to enter a binding contract. You must give accurate registration details and keep them current. You are responsible for everything that happens under your account, including keeping your password secure.

2. Accounts are either a brand or a creator

You choose your account type when you join. It cannot be changed afterwards, because campaigns, collaborations and payment history are tied to it. If you need both, register separately with a different email address.

3. Campaigns and collaborations

A brand publishes a campaign describing the video it wants, the deadline, the number of creator places and how payment is calculated. Creators apply, and the brand chooses who to work with. Being accepted creates an agreement between that brand and that creator for that piece of work. Take is not a party to it.

Each collaboration includes one round of requested changes. Further revisions are at the creator’s discretion unless the brand and creator agree otherwise in writing.

4. How creators are paid

A campaign pays in one of two ways, stated on the campaign itself:

  • A flat fee — a fixed amount per creator, paid once the brand approves the finished video.
  • Per views — an amount for every block of views on the creator’s live post, for example KES 30 for every 150 views. Every campaign of this kind has a spending limit set by the brand. Once that limit is reached the campaign stops earning, however many further views the post receives.

For per-view campaigns, the creator reports the view count on their live post and Take reviews it before it becomes payable. We may ask for evidence, and we may reject a figure we cannot verify. View counts are only ever adjusted upwards; an approved total is never reduced, so money already earned cannot be taken back.

Payments are made in Kenyan shillings to the M-Pesa number on your profile. Keep it accurate — we cannot recover money sent to a number you entered incorrectly. Mobile money fees and any taxes you owe on your earnings are your responsibility.

5. Funding and refunds

A brand funds a collaboration before the creator begins production. Held funds are released to the creator when the work is approved. If a collaboration is cancelled before any video is submitted, the brand may request the held amount back. Once a video has been delivered and approved, payment is final.

On a per-view campaign, the brand escrows the creator’s share of the campaign limit. Anything not earned through views remains the brand’s and can be released back on request.

6. Your content and who owns it

Creators keep ownership of the videos they make. On approval and full payment, the creator grants the brand a worldwide, perpetual licence to use that video to advertise and promote the products in the brief, across paid and organic channels.

The licence does not let a brand resell the footage, pass it to an unrelated third party, or imply a wider endorsement than the creator gave. Creators may show the work in their own portfolio.

You grant Take a limited licence to store, display and transmit your content so we can operate the platform, and to show approved work as an example of what is made here unless you tell us not to.

7. What you may not do

  • Upload content you do not have the rights to, including licensed music and other people’s footage.
  • Inflate, buy or otherwise manufacture views, or misreport a view count. This is fraud against a brand and will end your account.
  • Post content that is unlawful, hateful, sexually explicit, or that makes medical, health or financial claims you cannot substantiate.
  • Feature someone recognisable without their permission, or film where you do not have permission to film.
  • Take a collaboration off the platform to avoid fees, or attempt to interfere with, probe or overload the service.

8. Suspension and ending your account

You can stop using Take at any time. We may suspend or close an account that breaks these terms, and we may withhold payment on work connected to fraud or misreported views while we investigate. Where we can, we will tell you why and give you a chance to respond.

9. Pilot status and availability

Take is early software and is provided as is. We do not promise it will be uninterrupted or error free, and features may change. Uploads are subject to storage limits shown in the app.

10. Liability

Take operates the marketplace. We do not produce the videos, and we are not responsible for the quality of a creator’s work, a brand’s conduct, or how a brand later uses a video. To the extent the law allows, our total liability to you is limited to the fees payable on the collaboration the claim relates to.

11. Privacy

Our Privacy Policy explains what we collect and why. Your phone number is never shown to other users; it is used to pay you and to contact you about a collaboration.

12. Changes and governing law

We may update these terms. If a change is material we will ask you to accept the new version before you continue. These terms are governed by the laws of Kenya, and the courts of Kenya have exclusive jurisdiction.

13. Contact

Questions about these terms can go to [email protected].
